Terms of Service

The ALOS-4/ALOS-2 User Interface Gateway (AUIG4) is a system that offers a variety of online services related to the observational data of the Advanced Land Observing Satellite-2 (ALOS-2) and Advanced Land Observing Satellite-4 (ALOS-4), which are developed by the Japan Aerospace Exploration Agency (JAXA).

These Terms of Use state the terms and conditions under which you may use AUIG4. JAXA Site Policy is applied to matters that are not specified in these Terms of Use.
Please read carefully and ensure you accept these Terms of Use before using AUIG4. To use AUIG4, users must agree to these Terms of Use. You can accept the Terms by clicking to agree to these Terms of Use, where this option is made available to you by JAXA, or by actually using the services. In the latter case, users understand and agree that JAXA will treat their use of AUIG4 as acceptance of the Terms of Use from that point onward.

User Registration
You need to create a user account to use services made for registered users of AUIG4. User registration is only available if you have a joint research agreement/contract with JAXA. Your user account and password will serve as your login in the service for registered users of AUIG4.
The items required for AUIG4 user registration are a username and valid e-mail address, in addition to the user's affiliation, country, and telephone number.
For security reasons, AUIG4 requires you to provide a valid email address that reflects your educational or company affiliation (e.g., @jaxa.jp, @XX.edu, @companyname.com, or @XX.org). If you use an email address from Gmail, Yahoo, or any other free email provider, you may not be able to complete your registration or receive emails from AUIG4. User registration is unnecessary if you only use the service as a guest user.
Privacy Policy
The Privacy Policy of AUIG4 regarding personal information (e.g., username, valid e-mail address, the user's affiliation country, and telephone number) used for AUIG4 user registration is in accordance with JAXA's "Privacy Policy". For details, refer to "JAXA Privacy Policy". JAXA will not use personal information for any purposes other than those used for AUIG4.
In addition, please refer to our notice on the EU General Data Protection Regulation (GDPR) for information on handling personal information in accordance with that regulation.
The use of personal information includes the following;
- to perform statistical analyses so as to improve design, navigation, and experience of AUIG4
- to understand and to perform statistical analyses of user behavior and characteristics in order to measure use of the various sections of AUIG4 service to request user participation in surveys so as to improve AUIG4 service
- to respond to user inquiries
JAXA may outsource various parts of AUIG4 service to a third party. The parts that may be outsourced include system administration, user management, and help desk operations. The third party will use the registered personal information only to the extent necessary for the outsourced business.
Account and Password Management
A user is entirely responsible for maintaining the confidentiality of the user's account and password. Users agree that they are entirely responsible for any and all activities that occur under the user's account. JAXA is not responsible for any loss or damage caused by such activities, including unauthorized use of the user account or password by any third party.
Termination
If a user violates any of these Terms of Use or JAXA Site Policy or conducts any action that JAXA considers inappropriate, JAXA may suspend or terminate the user's access to AUIG4.
Modifications
JAXA reserves the right to modify any part or all of AUIG4, including this Terms of Use, at any time, with or without notice.
Modifications will be posted on AUIG4's website. It is the responsibility of the user to remain informed of any modifications at all times, as the user is bound by the latest version of the Terms of Use.
Limitation on Data Order
Due to network constraints or other limitations, the number of products a user can demand per order is limited to ensure a fair allocation of limited resources.
Conditions concerning AUIG4 Data Rights
1. (1) All rights to the products or data provided by AUIG4 (hereafter, AUIG4 data) belong to JAXA.
2. (2) Distribution or transfer to a third party
  Distribution or transfer of AUIG4 data to third parties is prohibited. However, this does not apply to value-added data or products (*) created by users using AUIG4 data.
  (*) Value-added data or products are data or products that have been modified through advanced data processing of AUIG4 data, in which the original AUIG4 data (hereinafter referred to as "original data") does not make up the majority of the data and in which the original data cannot be recognized/identified. Advanced data processing includes, but is not limited to, data analysis or combination of multiple satellite data, image processing based on external information other than the data, physical quantity conversion, etc.
3. (3) Use for commercial or profit-making purposes
  If you wish to use AUIG4 data for commercial or profit-making purposes, you must obtain prior permission from JAXA. Please contact the JAXA Business Development and Industrial Relations Department in advance.
4. (4) Acknowledgement of Data Credit
  The user shall indicate proper credit when the user publishes analyzed results from AUIG4 data.
  When the user publishes value-added data products generated by AUIG4 data, the user shall indicate the credit of the original AUIG4 data.
  Please refer to the following example to indicate the credit of the AUIG4 data.
  i.e. "PALSAR-3 data by the AUIG4, Japan Aerospace Exploration Agency."
  
  For value-added data products, please indicate the credit of the original AUIG4 data.
  i.e., "Original data for this value-added data product was provided by the AUIG4, Japan Aerospace Exploration Agency."
5. (5) Joint research agreement/contract
  Terms and Conditions of any joint research agreement/contract with JAXA regarding the use of AUIG4 and AUIG4 data supersede these Terms of Use. If you are using AUIG4 data under a joint research agreement/contract, please follow the conditions stated in such agreement/contract.
Disclaimer/Limitation on Liability
JAXA does not represent or warrant that the use of AUIG4 is safe or that the contents of AUIG4 are free of any harmful components. The data and information included in or available through AUIG4 may include inaccuracies or errors. JAXA does not represent or warrant that the data and information provided by AUIG4, the use of the results of the use of AUIG4 data, will be correct, accurate, timely, or otherwise reliable.
JAXA provides AUIG4 "as is" without warranty of any kind. It hereby disclaims all warranties and conditions regarding AUIG4 and makes no representations about its suitability, reliability, availability, timeliness, or accuracy for any purpose.
JAXA is not reliable for any damages or loss arising out of or in any way connected with the use or performance of AUIG4, with the delay or inability to use AUIG4, the provision of or failure to provide AUIG4, AUIG4 data or any information, products and related materials obtained through AUIG4, or otherwise arising out of or in any way connected with the use or the results of the use of AUIG4 data or any information, products or any related materials obtained through AUIG4.
JAXA may make changes to the data and information provided by AUIG4 at any time. JAXA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, AUIG4 (or any part thereof) with or without notice.
The user agrees that JAXA shall not be liable to the user or any third party for any modification, suspension, or discontinuance of AUIG4.
